BioMarin Shares Rise 5% After Ascendis Settlement

BioMarin Pharmaceutical Inc. (NASDAQ:BMRN) shares increased approximately 5% following the announcement of a worldwide settlement with Ascendis Pharma A/S that resolves ongoing patent disputes concerning Ascendis’s drug Yuviwel.

Under the settlement, Ascendis will remit royalties to BioMarin equal to 20% of Yuviwel net sales in the United States and 18% of Yuviwel sales in the European Union, Brazil and South Korea. These royalty obligations apply retroactively to the first commercial sale of Yuviwel and will continue until May 2030.

The agreement also provides BioMarin with a license to its patents covering Yuviwel for all current and potential indications, explicitly naming achondroplasia and hypochondroplasia, and extends to the use of Yuviwel in combination with other medicines.

In addition, BioMarin will dismiss the pending Section 337 investigation before the U.S. International Trade Commission. Both parties will resolve all remaining intellectual‑property claims, including litigation pending in Brazil, Denmark, Germany, South Korea and the Northern District of California.

The settlement acknowledges BioMarin’s innovations in C‑type natriuretic peptide technology, notably the development of VOXZOGO (vosoritide), and establishes a framework intended to maintain global access to treatment for children with achondroplasia.
