Detailed TDS Provisions

For Resident Members

  • General Rate: 10% if PAN is provided and aggregate dividend exceeds ₹10,000; 20% if PAN is invalid/not provided.
  • Nil TDS is applicable under specific conditions:
  • For resident individuals if aggregate dividend during Tax Year 2026-27 does not exceed ₹10,000.
  • For entities such as Mutual Funds, Insurance companies (registered with IRDAI), Category I & II AIFs (registered with SEBI), National Pension System Trust, and the Government, subject to providing requisite documentation.
  • For eligible resident shareholders who submit a duly signed Form 121.
  • Members can also submit a lower deduction certificate issued under Section 395 of the IT Act to apply a custom rate.

For Non-Resident Members

  • General Rate: 20% for FIIs/FPIs and other non-resident shareholders, plus applicable surcharge and a 4% cess.
  • A lower rate of 10% (plus surcharge and cess) applies to Category III AIFs located in an IFSC with units held solely by non-residents.
  • Beneficial rates under Double Taxation Avoidance Agreements (DTAAs) may be applied if the non-resident shareholder submits all required documents:

1. Copy of valid PAN (or details in Annexure 3 format if unavailable).

2. Copy of a valid Tax Residency Certificate (TRC).

3. Self-declaration in Form 41 (filed online).

4. Self-declaration of no Permanent Establishment in India and beneficial ownership (Annexure 4).

  • The company explicitly states it is not obligated to apply DTAA benefits and may deduct at 20% for FIIs/FPIs regardless of a DTAA or lower deduction order.

Submission Process and Requirements

  • All required documents (PAN, Form 121, Form 41, self-declarations, annexures) must be submitted as scanned, self-attested copies via the specified link: www.mdpl.in.
  • Documents submitted via email or hand delivery will not be considered.
  • Documents must be submitted afresh for Tax Year 2026-27 between August 24, 2026, and September 9, 2026. Submissions made prior to this communication will not be considered.
  • For joint holdings, the first-named shareholder must furnish the documents.
  • Non-individual members (e.g., Insurance companies, Mutual Funds, AIFs, FIIs, FPIs) may also submit documents through their custodian registered on the NSDL platform.

Additional Important Notes

  • The company will determine the TDS rate based on records provided by the depositories (for demat holdings) or the RTA (for physical holdings). No requests for revision of the TDS return will be entertained afterwards.
  • If tax is deducted at a higher rate due to non-receipt of documents, shareholders must file a return of income to claim a refund; no claim shall lie against the company.
  • The company reserves the right to reject documents found discrepant or incomplete and to recover demands from shareholders who provide wrong information.
  • SEBI Mandate for Physical Shareholders: Dividend will be paid only electronically after furnishing full KYC details (PAN linked with Aadhaar, contact details, bank account, nomination). If KYC is not updated, dividend will be withheld, and the shareholder will be ineligible for service requests.
  • TDS certificates will be emailed to registered email IDs post-dividend payment. TDS credit will be visible in Form 168 on the income tax e-filing portal (incometax.gov.in).
