TDS Provisions Overview
Dividend income is taxable under Income-tax Act. TDS governed by Income-tax Act, 2025 and Income-tax Rules, 2026 for tax year 2026-27.
Resident Individual Shareholders
- TDS rate: 10% of dividend payable (with valid PAN)
- No TDS required if conditions under section 393(4) and 393(6) of Income-tax Act, 2025 are satisfied:
- Dividend paid otherwise than in cash and aggregate dividend ≤ ₹10,000 during tax year
- Eligible resident individual furnishes Form No. 121 under section 393(6) with Rule 211 of Income-tax Rules, 2026
- Higher TDS rates apply if PAN not furnished or PAN inoperative/invalid (under section 397)
Resident Shareholders Other Than Individuals
- TDS at applicable rate unless specific statutory exemption applies
- No TDS required for entities covered under section 393(4), Table: Sl. No. 10:
- Life Insurance Corporation of India
- General Insurance Corporation of India and specified companies under General Insurance Business (Nationalisation) Act, 1972
- Other insurers
- Business trusts
- Other notified persons by Central Government
- Eligible shareholders must furnish self-declaration/supporting documents including PAN and registration evidence
Non-Resident Shareholders
- TDS generally at 20% plus applicable surcharge and health and education cess
- DTAA benefits available subject to conditions and documentation:
- PAN or identification details
- Valid Tax Residency Certificate (TRC)
- Form No. 41 for claiming DTAA benefits (replaces Form 10F)
- Other supporting declarations/documents
- Lower/nil deduction certificate may be furnished in Form No. 128
- FII/FPI provisions applied under Income-tax Act, 2025 and applicable Finance Act
