- PAN-Aadhaar linkage mandatory; non-linked PANs subject to 20% TDS
- Section 395 certificates accepted for lower/Nil rates if valid for tax year 2026-2027
Specific Resident Categories with Nil TDS
- Insurance Companies: Require PAN, registration certificate, and Annexure-2 declaration
- Mutual Funds: Must be specified under Schedule VII (Table Sl. No. 20 or 21) with Annexure-2
- Alternative Investment Funds (AIF): Category I or II AIFs governed by SEBI with PAN, registration certificate, and Annexure-2
- Recognized Provident Funds: Valid commissioner order or documentary evidence with Annexure-2
- Approved Superannuation/Gratuity Funds: Valid commissioner approval with Annexure-2
- National Pension Scheme: Documentary evidence with Annexure-2
- Entities exempt under Schedule VII: Annexure-2 declaration
- Corporations exempt from income-tax: Documentary evidence with Annexure-2
- Clearing Members/Intermediaries: Rule 203 declaration (Annexure-3) with Appendix A
- Other residents without PAN/Invalid PAN: 20% TDS rate
Non-Resident Shareholders
- Base TDS rate: 20% plus applicable surcharge and cess under Section 393 [Table 2 Sl. No. 15 or 17]
- DTAA benefits available if more beneficial
- Required documents: PAN (if available), Tax Residency Certificate (TRC), e-filed Form 41 (Annexure-4), Annexure-5 declaration
- DTAA rate application subject to document verification completeness
- Section 395 certificates accepted for lower/Nil rates
