1. NPPA Litigation on Drug Price Overcharging
The National Pharmaceutical Pricing Authority (NPPA) has issued demand notices since 1998 for alleged overcharging of scheduled drugs under DPCO-1995.
The company filed writ petitions in Bombay High Court in 1999-2000, which were initially decided in its favor in 2001 but set aside by the Supreme Court in 2003.
The Supreme Court stayed recovery of 50% of alleged overcharged amounts subject to deposit of remaining 50%. The company deposited ₹175.08 crore with NPPA in 2003.
Post-2003, the company received subsequent demands, including duplicate demands. The total amount under litigation after removing duplications aggregates to ₹2,011 crore (Principal: ₹863 crore, Interest: ₹1,148 crore).
On 15th July 2025, the company voluntarily deposited an additional ₹27.07 crore towards principal against certain demand notices, without prejudice to its position.
The matter is currently pending before the Supreme Court after the company appealed a Bombay HC order dated 23rd February 2024.
The company has been legally advised to expect a favorable outcome and has not recognized any provision for these demands.
