The Petitioner sought to have Company Petition No. CP No. 131/ND/2023, along with all its pending applications, listed for final disposal before a specific Special Bench of the NCLT. The Special Bench comprises Shri Manni Sankariah Shanmuga Sundaram (Member-Judicial) and Shri Atul Chaturvedi (Member-Technical).

The rationale was that this same Special Bench had already heard a similar petition, CP No. 70/ND/2023, and had reserved orders in it. CP No. 131/ND/2023 had also been heard by this Special Bench on a few previous occasions. The Respondent denied any "unwarranted allegations" mentioned in the application, to which the Petitioner's counsel clarified that no allegations were being levelled and the application was for a simple transfer.

The Hon'ble President, with the consent of both parties, allowed the transfer application (TA (Co. Act)- 13(PB)/2026).

The tribunal directed that both Company Petition No. CP No. 131/ND/2023 and CP No. 70/ND/2023 be listed before the Special Bench comprising Shri Manni Sankariah Shanmuga Sundaram and Shri Atul Chaturvedi for hearing and disposal.

The transfer application was disposed of as allowed.
