Court Directions

2. The Regional Provident Fund Commissioner, EPFO, Barrackpore (respondent No. 7) shall inform CSTC of the calculated amount and ensure transmission from the petitioner’s CPF account to EPFO by 30 November 2026.

3. The calculation must be communicated to both CSTC and the petitioner no later than 30 September 2026.

4. CSTC shall pay the balance of CPF contributions to the petitioner with interest at 6% per annum, accruing from the day after retirement until actual payment, and must complete payment by 30 November 2026.

5. If CSTC fails to meet the 30 November deadline, an additional interest rate of 2% per annum shall apply on the outstanding amount.

6. Upon receipt of the calculated amount, EPFO shall disburse the higher pension to the petitioner from October 2026 onward, in accordance with EPS provisions.

Final Outcome

  • The court disposes of WPA 21822 of 2026 with the above directions; no order as to costs; parties may obtain an urgent certified copy upon undertaking.
