Authority: National Company Law Appellate Tribunal, Principal Bench, New Delhi

Order Date: 16th October, 2026

Case Overview

This Interlocutory Application (No.7583/2026) was filed by Authum Investment & Infrastructure Ltd. (Appellant) against Ramanathan Bhuvaneshwari (Resolution Professional of R.P. Infosystems Ltd.) and Others (Respondents). The application sought an extension of time for curing defects in the filing of an un-numbered Company Appeal. The Appellant had initially e-filed the Memorandum of Appeal on 6th August 2026. The NCLAT Registry scrutinized the appeal and intimated defects to the Appellant on 20th August 2026. The Appellant refiled the appeal on 29th September 2026, which was 33 days beyond the required 7-day period for refiling after defect intimation.

The Appellant cited two primary reasons for the delay: (1) the voluminous nature of the appeal requiring extensive time for collating, bookmarking, indexing, restructuring, repagination, recompilation, and cross-referencing of numerous annexures running into several volumes, and (2) geographical coordination challenges as the Appellant's registered office is in Mumbai, the loan account in question is based in Kolkata, and the appeal needed to be filed before the NCLAT in Delhi.

Final Outcome

The Tribunal heard the Appellant's counsel and perused the application and office report. The Registry noted the 33-day delay in refiling against the 7-day requirement. The case was directed to be listed before the Hon'ble Bench under the heading 'for admission with defect (fresh case)' for appropriate orders on the condonation application.
