The Competition Commission of India (CCI) issued an order on 21 August 2026 imposing monetary penalties on Rekha Agencies and SS Marketing for engaging in anti-competitive bid rigging activities related to the Himachal Pradesh Tender 2013 for tyre procurement. The Commission found that both companies violated Sections 3(3)(d) read with Section 3(1) of the Competition Act, 2002, by exchanging commercially sensitive information regarding price bids through contemporaneous emails before bid submission, which constituted concerted action amounting to bid rigging.

Specifically, CCI imposed a penalty of ₹129,901 on Rekha Agencies and ₹213,274 on SS Marketing. The order also directed both companies to cease and desist from the anti-competitive conduct. Additionally, the Commission found an official of Rekha Agencies liable under Section 48 of the Act and imposed a monetary penalty, while proceedings against an official of SS Marketing were abated due to his demise.

The case was registered as Reference Case No. 01 of 2019, and the complete order is available on the CCI website at www.cci.gov.in. The order represents enforcement action against bid manipulation in government procurement processes.
