Authority: Calcutta High Court (WPA 4462 of 2026)

Order Date: 07 July 2026

Case Overview

  • Petitioner: Sundar Lal Kumar, retired employee of Calcutta State Transport Corporation (CSTC).
  • Respondents: The State of West Bengal & Ors.
  • Nature of proceedings: Writ petition seeking release of Provident Fund (PF) dues, interest on delayed PF and gratuity payments, and inclusion of dearness allowance (DA) in pension.
  • Background: Petitioner retired on 31 July 2025, received gratuity without DA component and has not been paid PF. He alleges pension also lacks DA.
  • The petitioner relies on earlier judgment in WPA 29126 of 2024 (Prosun Talukdar & Ors. Vs. State of West Bengal) which held that retired CSTC employees are entitled to gratuity and pension inclusive of DA, and directed the MD of CSTC to implement the DA component per memoranda dated 4 Sep 2025 and 14 Jan 2026.

Final Outcome

  • The Court disposes the writ petition and directs the Managing Director of CSTC to:

1. Disburse the petitioner’s PF dues with simple interest at 6% per annum, calculated from the date of retirement (31 July 2025) to the actual date of payment.

2. Pay interest on the delayed gratuity payment within twelve weeks from the date of communication of this order.

3. Disburse the dearness allowance component of the petitioner’s pension/gratuity within twelve weeks from the date of communication of this order.

4. If PF dues and DA are not cleared within the stipulated period, an additional 2% interest (total 8% simple interest) shall accrue from the retirement date until actual payment.

5. State authorities shall provide any necessary funds to CSTC to meet these obligations.

  • The petition is declared disposed.
  • An urgent certified copy of the order may be supplied to parties upon compliance with formalities.
