DAV Public School Case Dismissed by Odisha HC

The Odisha High Court (Cuttack Bench) dismissed Civil Miscellaneous Petition (CMP) No.1669 of 2016 filed by the Principal of DAV Public School, Gandarpur, Cuttack, which challenged the order dated 22 September 2016 of the 3rd Additional Civil Judge (Senior Division), Cuttack, rejecting an application under Order 7 Rule 11 CPC.

The court noted that the underlying civil suit C.S. III No. 817 of 2015 had been withdrawn on 12 November 2022 in the National Lok Adalat, rendering the petition without purpose.

Consequently, the CMP was dismissed, the earlier interim order was vacated, and Miscellaneous Case No. 1761 of 2016 was also disposed.
