Authority: National Company Law Appellate Tribunal (NCLAT) Principal Bench, New Delhi
Order Date: 17th July, 2026
Case Overview
This Interlocutory Application (IA No.4837/2026) was filed by Ebix Singapore Pvt. Ltd. & Anr. (Appellants) against State Bank of India (Respondent). The Appellants sought an extension of time and condonation of delay for curing defects in the refiling of their Memorandum of Appeal. The appeal was initially e-filed on 18th April 2026. The NCLAT office scrutinized it and intimated the defects to the Appellant on 27th April 2026. The Appellant was required to re-file the corrected appeal within seven days of this intimation. However, the appeal was only re-filed on 13th July 2026, resulting in a 70-day delay. The Appellants submitted that the delay was bona fide and unintentional, caused by the considerable time required to coordinate across different jurisdictions and to obtain complete instructions and records relating to the impugned proceedings and connected litigation.
Final Outcome
After hearing the Learned Counsel for the Applicant and perusing the application and office report, the Registrar noted the 70-day delay in refiling. The case was directed to be listed before the Hon'ble Bench under the heading 'for admission with defect (fresh case)' for appropriate orders. The application for condonation of delay was thus placed before the bench for a decision.
