Authority: The National Company Law Appellate Tribunal Principal Bench, New Delhi

Order Date: 15th October 2026

Case Overview

This is an Interlocutory Application (IA No.7513/2026) filed by EEPOS GmbH (Appellant) against Fine Handling and Automation Pvt. Ltd. and Another (Respondents). The application seeks an extension of time for curing defects in the filing of a Memorandum of Appeal. The Appellant had initially e-filed the appeal on 27th May 2026. The NCLAT registry scrutinized the filing on 1st July 2026 and intimated defects to the Appellant on the same day. The Appellant states that it discussed these defects with local advocates in Pune and re-filed the appeal on 7th August 2026. However, a portal glitch prevented the registry from viewing the re-filed document until the NCLAT IT team resolved the issue on 28th August 2026. The same defects were remarked upon by the registry on 22nd September 2026, and this defect marking persisted. This resulted in a total delay of 90 days in the refiling process, which the Appellant seeks to have condoned.

Final Outcome

The Tribunal heard the Learned Counsel for the Appellant and perused the application and office report. It was noted that the Appellant was required to re-file within seven days of the initial intimation but did so with a 90-day delay. The Counsel for the Appellant submitted that a connected appeal (Company Appeal (AT) No.313 of 2026) is scheduled for hearing on 26th October 2026 and requested that this matter also be listed alongside it. The Tribunal accepted this submission and directed that this appeal be listed for admission (fresh case) along with the connected appeal on 26th October 2026.
