Enel, the Italian energy group, submitted a filing to Brazil’s electricity regulator Aneel on Thursday, marking its final defence against a regulatory proceeding that could lead to the termination of its Sao Paulo electricity distribution concession. The filing asks Aneel to cancel the ongoing review, arguing that the regulator has not properly assessed the impact on consumers.
Aneel had earlier concluded that Enel’s Sao Paulo distribution unit suffers from structural failures and highlighted poor service performance during extreme weather events in 2023, 2024 and 2025, which resulted in millions of customers experiencing prolonged power outages. The regulator’s assessment forms the basis for a possible recommendation to the federal government to end the concession.
Enel counters that it has satisfied the two official service‑quality metrics that could justify a termination recommendation. The company describes the outage that occurred in December 2025 as “unprecedented and extraordinary” and maintains that Aneel is overlooking the performance improvements it has achieved since 2023.
In addition, Enel renewed its request for an independent technical audit of the concession’s operations. Aneel had rejected this request in August after members of its board criticized the proposal, leaving the audit pending.
The outcome of Aneel’s decision will determine whether the concession is recommended for termination to the federal authorities, with significant implications for Enel’s operations and millions of electricity consumers in Sao Paulo.
