Authority: National Company Law Appellate Tribunal, Principal Bench, New Delhi

Order Date: 13th August, 2026

Case Overview

This Interlocutory Application (No.5667/2026) arises from an un-numbered Company Appeal filed by the Employees Provident Fund Organisation (Appellant) against NDA Metaoxides Pvt. Ltd. (Respondent). The Appellant e-filed its Memorandum of Appeal on 17th March, 2026. The NCLAT office scrutinized the filing on 24th March, 2026 and intimated defects to the Appellant on the same day. The Appellant was required to re-file the corrected appeal within seven days of this intimation. However, the Appellant only re-filed the appeal on 4th August, 2026 - 126 days after the deadline. In its application, the Appellant cited several reasons for the delay: time taken to obtain internal approvals from competent authority; administrative processing within the department; collating records and obtaining signatures and stamps of the Authorized Representative on annexures; and typing/translating documents. Additionally, the Appellant stated it was simultaneously preparing nine other defect-free appeals, and its Panel Counsel was engaged in appearances and proceedings before various District Courts, High Courts, and the Supreme Court of India.

Final Outcome

The Registrar, after perusing the application and office report in the absence of any appearance for the Appellant, noted the 126-day delay in refiling. The case was directed to be listed before the Hon'ble Bench "for admission with defect (fresh case)" for appropriate orders. The tribunal has not yet ruled on the condonation application.
