Authority: National Company Law Tribunal, New Delhi Single Principal Bench
Order Date: 10 July 2026
Case Overview
The application was filed by Futurense Technologies Private Limited seeking transfer of C.P. (IB) No. 231/2024 from NCLT Bengaluru Bench to NCLT New Delhi Bench. The petition was originally filed by Miles Education Private Limited under Section 7 of the Insolvency and Bankruptcy Code, 2016, seeking initiation of Corporate Insolvency Resolution Process (CIRP) against Futurense Technologies.
During the pendency of the Section 7 petition, the respondent (Miles Education) had filed CP-81 of 2025 under Sections 241-242 of the Companies Act, 2013 alleging oppression and mismanagement before NCLT New Delhi. The applicant's registered office was shifted from Bengaluru to New Delhi on 07 November 2024, as approved by the Regional Director. On 05 February 2026, NCLT Bengaluru had observed that parties may take appropriate steps to place the matter before a single bench to avoid divergent views.
The respondent opposed the transfer, arguing that the two proceedings were independent and no case for transfer had been made out.
Final Outcome
The NCLT President, Justice Anupinder Singh Grewal, allowed the transfer application (TA(IBC)-20/2026). C.P. (IB) No. 231/2024 stands transferred from NCLT Bengaluru to Court-III, NCLT New Delhi, which is already hearing the oppression and mismanagement petition (CP-81/2025) between the same parties. The bench considered the shifting of registered office to Delhi and the existence of parallel proceedings between the same parties in Delhi as sufficient grounds for transfer to avoid potential divergent views.
