Order Details

A) Mr. Abhishek Kothari, Advocate of this Court, is appointed as the Sole Arbitrator. Office address: C/o Sr. Adv. Ashish Kamat, 501, Oval House, British Hotel Lane, Kala Ghoda, Mumbai – 400001. Email: abhishekkothary@gmail.com.

B) A copy of this Order shall be communicated to the Sole Arbitrator by the Applicant’s advocates within one week; the Applicant must also provide the contact particulars of both parties to the Arbitral Tribunal.

C) The Sole Arbitrator is directed to forward the statutory Statement of Disclosure under Section 11(8) read with Section 12(1) of the Act to the Applicant’s advocates for filing in the Court Registry; a copy shall also be furnished to the Respondent’s advocates.

D) The Statement of Disclosure must be forwarded to the parties within two weeks of receipt of this Order.

E) Parties shall appear before the Sole Arbitrator on a date and place indicated by him to obtain directions on conduct of proceedings, including schedule for pleadings, witness examination, and hearing dates. Parties must provide valid email addresses and telephone numbers of their advocates; service to these email addresses shall constitute valid service.

F) All arbitral costs and fees shall be borne equally by the parties initially, subject to any adjustment by the final award of the Arbitral Tribunal.

The Sole Arbitrator is empowered to adjudicate any claims, counter‑claims, and merits in accordance with law. All actions required under this order shall be taken upon receipt of a downloaded copy from the Court’s website.
