Class-action lawsuit pending against Indegene, Inc. before the U.S. District Court, District of New Jersey under the Telephone Consumer Protection Act, 1991.

Recent Development

On 27 August 2026, the Court issued an order preliminarily approving the proposed class action settlement entered into between the parties. The preliminary approval order does not constitute final approval of the settlement.

Court Directives

  • Approved the form and manner of notice to the settlement class
  • Appointed Analytics as the Settlement Administrator
  • Directed issuance of notice to settlement class members on or before 10 September 2026
  • Established timelines for submission of claims, requests for exclusions and objections by 9 December 2026
  • Scheduled final approval hearing for 12 January 2027

Settlement Framework

The settlement provides for:

  • Maximum settlement fund of approximately USD 4.72 million
  • Payment of USD 250 per eligible approved claim
  • Claims-made structure where actual payments depend upon valid claims received and approved
  • Retention/reversion to defendants of amounts not required to satisfy approved claims and other agreed settlement payments
  • No requirement to deposit, escrow or pre-fund the entire maximum settlement fund
  • Payment of Court-approved class counsel fees and other amounts contemplated under the settlement agreement
  • Settlement administration in accordance with Court-approved notice and claims process

Current Status and Financial Impact

No payment has been made to class members at this stage. The settlement remains subject to completion of the notice and claims administration process and final approval by the Court. The maximum settlement fund should not be interpreted as the expected cash outflow.

The actual financial impact will depend principally on:

  • Number of valid claims ultimately submitted and approved
  • Court-approved counsel fees
  • Administration costs
  • Other amounts payable under the settlement agreement
