Authority: The National Company Law Appellate Tribunal (NCLAT) Principal Bench, New Delhi

Order Date: 6th July, 2026

Case Overview

This is an order concerning an Interlocutory Application (IA No.4466/2026) filed by Jaypee Infratech Ltd. The application seeks an extension of time for curing defects in the filing of an un-numbered Company Appeal. The appellant, Jaypee Infratech Ltd, had originally e-filed the Memorandum of Appeal on 28th April 2026. The NCLAT office scrutinized the filing and intimated the defects to the appellant on 2nd May 2026. The appellant was required to re-file the corrected appeal within seven days of this intimation. However, the re-filing was completed only on 18th June 2026, resulting in a delay of 40 days. The appellant cited several reasons for the delay, including the voluminous nature of the appeal which required detailed restructuring, recompilation of records, re-pagination, and cross-referencing of annexures. Additional time was needed to obtain clear copies of some documents. The appellant also noted that being based in a different state caused inadvertent delays in the handover and coordination of documents, and that some delay occurred due to the intervening summer vacation.

Final Outcome

After hearing the learned counsel for the appellant and perusing the application and office report, the Registrar noted the 40-day delay in refiling the Memorandum of Appeal. The Registrar did not condone the delay in this order but directed that the case be placed before the Hon'ble Bench for appropriate orders. The case is to be listed under the heading 'for admission with defect (fresh case)'.
