NCLT Kochi dismissed Kerala Financial Corporation's application to be impleaded as a respondent in a post-approval resolution plan matter.
The applicant, a dissenting financial creditor with 19.48% CoC voting rights, had challenged the approved Sharon Hills resolution plan at NCLAT.
The tribunal ruled the dissenting creditor has no locus to interfere in matters between the SRA and RP post-plan approval.
The application was dismissed with costs of ₹5,000 to be deposited with the National Defence Fund.
