NCLAT disposes of Kunal Structure's appeal against third member's opinion favoring CIRP admission for Kotak Mahindra Bank's Rs 18.11 crore debt.
Appellant cited Vidarbha Industries judgment and Rs 76.87 crore arbitral awards against NHAI and Rajkot Municipal Corporation as grounds to defer insolvency.
Tribunal directs NCLT Ahmedabad to consider all subsequent events, including execution progress of awards, while deciding Section 7 application.
Parties instructed to appear before NCLT on 2nd June 2026 for final hearing on admission of corporate debtor into CIRP.
