Maksud Ali Granted 6% Interest on Benefits

Petitioner: Maksud Ali, a retired employee, filed writ petition WPA 15895 of 2025 against the State of West Bengal, West Bengal Transport Corporation Limited (WBTCL) and other respondents, alleging delayed payment of retirement benefits.
The petitioner retired on 31 March 2024; first instalment of Rs 14,94,977 was paid on 29 April 2024 (28‑day delay) and second instalment of Rs 33,84,866 on 26 March 2025 (360‑day delay).
The petitioner sought interest on the delayed amounts; the matter had been previously settled by a Division Bench in APOT 243 of 2022, leaving only the interest issue for adjudication.

The Court directs respondents to pay interest at 6 % per annum on Rs 48,79,843 from 1 April 2024 to 28 April 2024, and on Rs 33,84,866 from 30 April 2024 to 25 March 2025.
The total interest amount is to be disbursed to the petitioner by 31 July 2026; failure to do so will raise the interest rate to 10 % per annum.
The Principal Secretary, Department of Finance, Government of West Bengal is instructed to ensure compliance.
No order as to costs; an urgent certified copy of the order may be provided to the parties.
