Authority: High Court
Order Date: 16 July 2026
Case Overview
- Petitioners: Midland Nursing Home Private Limited and another; Respondent: LIC Housing Finance Limited and others.
- This is the fourth writ petition (WPA 16515 of 2026) challenging actions of the respondent under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).
- In the preceding round (WPA 1510 of 2026) the Court disposed of a petition involving an order dated 15 December 2025 and, on 29 January 2026, granted the petitioners liberty to approach either the Debts Recovery Tribunal (DRT) or the Debts Recovery Appellate Tribunal (DRAT) and to have the issue decided before any further proceeding in SARFAESI Application SA 712 of 2024.
- The petitioners subsequently filed a review application before the DRT; the Tribunal issued an order on 25 March 2026. No appeal has been filed before the DRAT. A further application for review and recall of the 25 March 2026 order is pending before the DRT.
- The petitioners now seek a stay of all actions of the respondent under the 2002 Act, noting that the main SARFAESI application (SA 712 of 2024) was filed in 2024 and that numerous interlocutory applications have been filed over the two‑year period.
- The Court observes that the next date fixed before the DRT is 24 July 2026 and suggests that the Tribunal dispose of the SARFAESI application SA 712 of 2024 along with all connected applications preferably by the end of August 2026.
- The Court clarifies that it has not gone into the merits of the petitioners' case; all points remain open for determination by the Tribunal in accordance with law.
Final Outcome
- WPA 16515 of 2026 is disposed of with the above observations.
- No costs are awarded.
- All substantive issues are left to be decided by the Debts Recovery Tribunal.
