Authority: National Company Law Appellate Tribunal Principal Bench, New Delhi
Order Date: July 21, 2026
Case Overview
This appeal (Comp. App. (AT) (Ins) No. 1042 of 2026) was filed by Bindu Kapoor, Suspended Director of Bliss Abode Pvt. Ltd., against an order dated May 29, 2026, passed by the NCLT, New Delhi in I.A No. 1978 of 2026 in CP (IB) No. 474 of 2025. The NCLT order had directed the immediate handing over of peaceful physical possession of the Corporate Debtor's registered office situated at 40, Amrita Shergill Marg, New Delhi 110003, including all movable and immovable assets, to the Resolution Professional (Mamta Binani) as required under Section 17 of the Insolvency and Bankruptcy Code.
The Resolution Professional alleged that while the Enforcement Directorate (ED) was in constructive possession of the property, the keys were with the Corporate Debtor, who had changed the locks and put their own locks on the registered office. The RP intended to file an affidavit regarding this matter.
The Enforcement Directorate contended that by taking possession of the property, the NCLT order violated a status quo order dated January 27, 2021, passed by the Appellate Tribunal for FEMA, PMLA and PBPT Act.
Final Outcome
The NCLAT adjourned the case to August 14, 2026. The RP was directed to file their affidavit within one week. The Appellant (Bindu Kapoor) was granted three weeks to file a rejoinder to the ED's reply and a counter affidavit to the RP's submissions. Additionally, the Committee of Creditors sought permission to file an impleadment application, which will be considered on the next hearing date. The matter remains pending with no final determination on the possession dispute.
