Authority: National Company Law Appellate Tribunal (NCLAT) Chennai Bench
Order Date: 22 June 2026
Case Overview
The NCLAT Chennai heard three interconnected Company Appeals filed by entities within the Lulu Group against orders related to the corporate insolvency resolution process of Katerra India Private Limited. The primary appeal, Company Appeal (AT) (CH) (Ins) No. 622/2025, was filed by Lulu India Shopping Mall Pvt Ltd challenging the impugned order dated 26 September 2025 passed by the NCLT Bengaluru Bench in IA(IBC)267/BB/2025, which was itself filed in CP(IB)74/BB/2023 (the main corporate insolvency petition against Katerra India). Two other appeals were also listed: Company Appeal (AT) (CH) (Ins) No. 45/2026 filed by Lulu India Shopping Mall Private Limited and Company Appeal (AT) (CH) (Ins) No. 72/2026 filed by Lulu IT Infrabuild Pvt. Ltd., both against Katerra India Pvt. Ltd. through its Resolution Professional, Mr. Pankaj Srivastava.
Final Outcome
The NCLAT allowed two interlocutory applications (IAs) seeking condonation of delay in filing the appeal. IA No. 1726/2025, seeking condonation of 6 days delay in preferring the appeal, was allowed after the Bench found the reasons stated in paragraphs 7 and 8 of the supporting application satisfactory. IA No. 1838/2025, seeking condonation of 1 day delay in refiling the appeal, was also allowed. The respondents were directed to file their counters to the main Company Appeal. The other two connected appeals were directed to be listed on the same day 'For Orders' on their respective condone delay applications. All three appeals were listed for next hearing on 13 August 2026.
