Authority: National Company Law Appellate Tribunal (NCLAT) Principal Bench, New Delhi

Order Date: July 7, 2026

Case Overview

The National Company Law Appellate Tribunal (NCLAT) has admitted two connected appeals (Company Appeal (AT) (Insolvency) No. 1173 of 2026 and 1174 of 2026) filed by homebuyers of the Corporate Debtor, Angle Infrastructure Pvt. Ltd. The appellants, Geeta Mehrotra & Others and Harshit Mehrotra (through a Power of Attorney holder), are homebuyers who had previously obtained a decree from the Real Estate Regulatory Authority (RERA) for a refund of the money they had paid to the Corporate Debtor.

Following the commencement of the Corporate Insolvency Resolution Process (CIRP) against Angle Infrastructure, the appellants joined the process alongside other homebuyers. A resolution plan was eventually approved. Under the terms of this plan, the appellants were to be allotted the apartments originally allotted to them. However, the plan stipulated that homebuyers who had not paid the entire sale consideration were required to pay the balance amount.

The core contention of the appellants is that the amount awarded to them by the RERA for a refund should be set off against this balance sale consideration they are now required to pay under the resolution plan. This specific plea was rejected by the Adjudicating Authority (presumably the National Company Law Tribunal), leading to the present appeal before the NCLAT.

Final Outcome

The NCLAT bench, comprising Justice N. Seshasayee (Member-Judicial) and Barun Mitra (Member-Technical), issued formal notice to the respondents, who include the Resolution Professional, Sarvesh Kashyap, for Angle Infrastructure Pvt. Ltd. The appellants were directed to provide the mobile numbers and email addresses of the respondents and to file the requisite paperwork and process fee within two days. Notice is to be served via email or other available modes. The appeal has been listed for the next hearing on August 17, 2026. The tribunal has not made any ruling on the merits of the set-off claim at this stage.
