The IRP must examine the application by obtaining details of all creditors from the personal guarantor, notify all creditors and the personal guarantor through all modes, seek their responses, and prepare a report recommending either acceptance or rejection of the application.
The Tribunal specifically directed the IRP to examine the aspects of "Debt", "Default", "Invocation of Guarantee", and "Limitation" in the report and offer comments regarding the maintainability of the petition. The IRP must file the report through a separate IA in this matter after serving it on all creditors, personal guarantor, and corporate debtor. The matter has been listed for next hearing on 17 August 2026 for consideration of the report to be filed by the IRP.
