Case Overview

The National Company Law Tribunal (NCLT) Allahabad Bench heard multiple applications in the ongoing liquidation proceedings of JVL Agro Industries Ltd under Section 7 of the Insolvency and Bankruptcy Code (IBC). The primary application (IA No.807/2025) was filed by the Liquidator seeking directions for demarcation of approximately 25 Bighas of land situated at Kamalpur near Guwahati, Assam. The liquidation process was initiated pursuant to an order dated 19th August, 2020 passed in CA No.215/2029.

The Liquidator submitted that despite repeated letters and reminders sent to the Circle Officer of Kamalpur Revenue Circle, Dimu Road, District Kamrup, Guwahati, Assam, no action had been taken to demarcate the land parcel. This lack of demarcation has prevented the Liquidator from crystallizing and processing the asset for liquidation, leaving it idle. Notices were issued to the non-applicants/respondents including the Circle Officer, but no responses or replies were filed.

The land in question was acquired by the Corporate Debtor through different deeds executed at various points in time, with details provided in Annexure-A-2 (Pages 23-24) and a table at Page 26 of the paper book.

Final Outcome

The NCLT directed the Learned District Magistrate of Kamalpur to investigate why the demarcation process had not been completed by the Circle Officer and to ensure the demarcation is carried out for the specified land assets. The District Magistrate must file a status report with the Tribunal registry within four weeks. The matter has been adjourned to 5th August, 2026 for further hearing.

Other applications in the case (MA No.13/2022, IA No.113/2023, IA No.355/2024, MA No.17/2022, IA No.627/2024, and Ivn.P No.05/2026) were also adjourned to hearing dates in August 2026.
