NCLT Directs Sathavahana Ispat Resolution Applicant to Pay Full EPFO Dues

NCLT Hyderabad disposes of EPFO's application seeking full payment of ₹1.30 crore in outstanding provident fund dues from Sathavahana Ispat Ltd.
Tribunal cites NCLAT and Supreme Court precedents, ruling that PF dues must be paid in full by the Successful Resolution Applicant, notwithstanding the approved resolution plan.
EPFO had submitted a final claim of ₹2.28 crore but received only ₹97.69 lakh under the plan approved on 31 March 2023.
The order clarifies that PF dues are excluded from liquidation estate and not subject to Section 53 waterfall mechanism under IBC.
