Authority: National Company Law Tribunal Kolkata Bench
Order Date: 22nd June 2026
Case Overview
The National Company Law Tribunal (NCLT) Kolkata Bench, comprising Hon'ble Member (Judicial) Shri Labh Singh and Hon'ble Member (Technical) Ms. Rekha Kantilal Shah, heard an insolvency petition filed under Section 9 of the Insolvency and Bankruptcy Code, 2016 (IBC). The petition was filed by operational creditor Sudarshan Paper & Board Private Limited against corporate debtor The Offsetters (India) Private Limited. Counsel for the operational creditor, Mr. Avishek Guha, along with Ms. Ankita Agrahari, Ms. Sweta Majumder, and Ms. Anusha Nayek, appeared for the hearing.
The Tribunal noted that as per the amended provisions of the IBBI (Insolvency Resolution Process for Corporate Persons) (Third Amendment) Regulations, 2026, an operational creditor must submit specific GST documentation along with the application. This includes relevant extracts from Form GSTR-1 and Form GSTR-3B filed under GST laws, and copies of e-way bills where applicable.
Final Outcome
The learned counsel for the operational creditor was directed to file the required GSTR-1 and GSTR-3B extracts in a tabular format, disclosing the sales recorded in the GST returns. The counsel was further directed to file all other relevant documents as required under the amended Regulation 2B of the CIRP Regulations, 2016. This compliance must be completed within five days from the order date (22nd June 2026), and a copy must be supplied to the other side (the corporate debtor). The matter was adjourned and listed for the next hearing on 10th July 2026.
