NCLT Dismisses EPFO's Rs 1.12 Crore Liquidation Claim

NCLT Jaipur Bench dismissed EPFO's application seeking payment of Rs 1.12 crore from Tonk Water Supply Limited's liquidation estate.
The claim was rejected as it was based on an assessment report dated 23.08.2024, which was after the liquidation commencement date of 22.12.2023.
The tribunal ruled that no assessment proceedings under the EPF Act can be initiated or continued after the imposition of a moratorium under IBC.
The EPFO failed to demonstrate the existence of any segregated or identifiable provident fund corpus in the corporate debtor's books.
