Authority: National Company Law Tribunal, Indore Bench, Court No. 1

Order Date: 29/06/2026

Case Overview

The application was filed by Efficax Resolution Professionals Pvt Ltd, the liquidator of Sun Petpack Jabalpur Pvt Ltd, seeking substitution in place of the erstwhile Resolution Professional, Mr. Mangesh Kekre, in a pending application (IA/280(MP)/2025). The Corporate Insolvency Resolution Process (CIRP) of Sun Petpack Jabalpur was initiated on 04.04.2024. During the CIRP, the erstwhile RP had filed IA/280(MP)/2025 under Sections 43 and 66 of the Insolvency and Bankruptcy Code, 2016, seeking reliefs concerning preferential, undervalued, extortionate, and fraudulent transactions (PUFE Application). The tribunal had subsequently ordered the liquidation of the corporate debtor on 30.01.2026 and appointed the present applicant as the liquidator. The applicant argued that the PUFE Application constitutes an actionable claim and an asset of the corporate debtor's estate, which the liquidator is statutorily obligated under Section 35(1) of the IBC to take control of and pursue for the benefit of creditors.

Final Outcome

The tribunal allowed the application (IA/380(MP)/2026). Efficax Resolution Professionals Pvt Ltd is substituted as the applicant in place of Mr. Mangesh Kekre in the pending PUFE Application (IA/280(MP)/2025). The liquidator's counsel was directed to carry out the necessary amendments to the application within one week and serve a copy of the amended application upon the respondent.
