NCLT Ahmedabad rejected an insolvency petition filed by GD Waldner India against Dishman Carbogen Amcis over a claimed default of Rs 2.47 crore.
The tribunal found evidence of pre-existing commercial disputes regarding work quality, delays, and contractual terms, which were raised by Dishman.
Dishman demonstrated solvency by having made payments totaling Rs 3.01 crore against the project value and honoring initially dishonored cheques.
The order cited established legal precedent that the existence of a dispute, even if raised beyond 10 days, is grounds for rejecting a Section 9 application.
