PNB Housing Finance Wins Mandamus for DRT Order

Nature of Petition: Writ petition under Article 226 of the Constitution seeking a writ of mandamus directing the DRT to dispose of Securitisation Application (SA) No.370 of 2023.
Background: The SA challenging an order passed under Section 14 of the SARFAESI Act was filed on 29 April 2023. The Tribunal reserved the SA for orders on 2 July 2025. After further hearings, the Tribunal again reserved the SA for orders on 28 January 2026. Despite being listed for orders on twelve occasions up to 5 June 2026, no final order had been delivered, resulting in a delay of approximately five months after reservation.

The Court directs the Debts Recovery Tribunal, Coimbatore, to deliver its order in SA No.370 of 2023 within two weeks of receiving a copy of this Court order.
The writ petition is disposed of with no order as to costs.
