Case Overview
- Petition W.P.A. 20527 of 2026 filed by Prasun Sarkar against The Calcutta State Transport Corporation (CSTC) and others, represented by counsel.
- The dispute concerns the calculation and transmission of pension contributions under the Employees' Pension Scheme, 1995 (as amended), to the Employees' Provident Fund Organisation (EPFO).
- EPFO issued a demand letter on 19 July 2024 stating that as of 30 September 2024, Rs 4,36,385 was due, including interest, for the petitioner’s CPF contributions.
- The petitioner alleges that approximately 90% of his CPF dues remain unpaid by CSTC despite the demand letter, preventing him from receiving a higher pension.

2. The Regional Provident Fund Commissioner, EPFO, Barrackpore (respondent No. 7), must inform CSTC of the updated calculation by 30 September 2026.
3. CSTC must transmit the calculated amount to EPFO by 30 November 2026, and subsequently ensure the higher pension is credited from October 2026.
4. CSTC is ordered to pay the balance of the CPF to the petitioner with interest at 6% per annum, accruing from the petitioner’s retirement date until actual payment.
5. The calculation and related communication shall be provided to both CSTC and the petitioner at the earliest, but no later than 30 September 2026.
6. Upon receipt of the amount, the authority shall disburse the higher pension to the petitioner from October 2026 onward.
7. The petition is disposed of with no order as to costs.
8. An urgent certified copy of the order may be obtained by the parties upon usual undertaking.
