Authority: Appellate Authority under the RTI Act, Securities and Exchange Board of India
Order Date: July 30, 2026
Case Overview
The appeal was filed by Sunil Kumar Singh, a PACL investor, against the response provided by the CPIO, SEBI, Mumbai to his Right to Information (RTI) application dated June 16, 2026. The appellant identified himself as a PACL investor who was allotted land at Samesi, Lucknow under Allotment No. LK-1311. He sought comprehensive information regarding this allotment, including complete details of the land, project name, plot number, khasra/gata number, area, exact location, and certified copies of the allotment letter, possession letter, and sale deed/registry documents. He also requested information on the current status of the land and the authority holding it, and if no allotment was made, the status of his refund claim.
The respondent (CPIO, SEBI) had responded on June 23, 2026, stating that all communication regarding refund status is handled by the Justice (Retd.) R.M. Lodha Committee and advised the appellant to approach that Committee. The respondent also informed that details of PACL matters are available on the SEBI website.
The appellant filed the appeal on July 05, 2026 (Reg. No. SEBIH/A/E/26/00243) on the ground that he was refused access to the requested information.
The Appellate Authority, after perusing the application, response, and appeal, observed that the respondent's reply was unclear on whether the requested information was available with SEBI and found that the queries had not been adequately addressed.
Final Outcome
The Appellate Authority disposed of the appeal and remitted the application to the respondent (CPIO, SEBI) for de novo (fresh) consideration. The respondent was directed to send an appropriate response to the appellant in terms of the RTI Act within 15 working days from the date of receipt of the order.
