Skylit Engineers vs Mysore Housing: Arbitrator Appointed

Petition No. 422 of 2025 filed by M/S Skylit Engineers and Infrastructure (P) Ltd (formerly Skytech Engineers and Builders Pvt. Ltd.) against Mysore Rural Karnataka State Road Transport Corporation Employees Housing Co‑operative Society Ltd, seeking appointment of a sole arbitrator under Section 11(5) of the Arbitration and Conciliation Act, 1996, based on Clause 16 of the MOU dated 29 July 2010.
The parties exchanged legal notices; the petitioner earlier filed a civil matter (CMP No.17/2025) which the Court disposed on 10 June 2025, holding that the notice did not satisfy Section 21 of the Act.
After that order, the petitioner issued a notice dated 21 June 2025 nominating a sole arbitrator; the respondent replied on 12 July 2025 denying the petitioner’s claims.
The Court examined the records and concluded that an arbitrable dispute exists and, given the circumstances, a former judge of the Court should be appointed as sole arbitrator.

The petition is allowed; Justice B A Patil, former Judge of the Karnataka High Court, is appointed as the sole arbitrator to refer the dispute and conduct proceedings at the Arbitration and Conciliation Centre (Domestic and International), Bengaluru, in accordance with the Centre’s Rules.
The Registry is directed to communicate the order by e‑mail to the Centre and to Justice B A Patil at the address provided (House No.1327, 4th Cross, 5th Main Road, 5th Block, HMTHBCS Layout, Nagasandra Post, Bengaluru‑560073; email: bapatil@gmail.com) as per the Appointment of Arbitrators by the Chief Justice of Karnataka High Court Scheme, 1996.
Both parties are directed to appear before the Director of the Arbitration and Conciliation Centre on 27 July 2026 at 11:30 am.
