d) The Respondents have transferred vacant possession of the appellants' portion to the appellants.

e) Both parties are enjoying peaceful possession of their respective portions.

f) Neither party shall interfere with the other's possession.

Court Directions

1. All legal proceedings pending inter se between the parties, if any, shall stand closed.

2. The impugned judgment/order dated 04.01.2017 shall stand modified accordingly.

3. A decree shall be drawn up in accordance with the settlement.

4. Both parties must continue to abide by the settlement terms without exception.

5. Parties shall file a usual undertaking before the Registry within four (04) weeks from the order date; failure will invite appropriate action by the Registry.

6. The settlement terms are binding; parties undertake to comply.

7. Parties were warned, through counsel, of contempt proceedings for any breach of the settlement.
