Observations & Directions

1. Respondent 1 (Sati Mata Shkshan Sanstha) has obtained acceptance of its request for allotment of an alternative plot; the Nagpur Improvement Trust has forwarded the matter to the State Government for the necessary approval.

2. Respondent 2 alleges that the width of the road under the development plan has been reduced from 09 metres to 06 metres; he has filed an application with the Nagpur Improvement Trust seeking appropriate orders.

3. The Nagpur Municipal Corporation, appearing before the Court, stated that it is the competent authority to consider the representation of Respondent 2. Accordingly, Respondent 2 is directed to file a fresh representation before the Nagpur Municipal Corporation within four weeks from the date of this order, enabling the corporation to take a final decision in accordance with law.

4. The matter is listed for further hearing after the four‑week period.

5. The petitioner is directed to inform the Court of the outcome of the pending matter before the State Government concerning Respondent 1.

6. An interim order to continue the proceedings is issued pending the next date of hearing.

7. The interim order maintaining the status‑quo shall not impede the State Government, Nagpur Improvement Trust, or Nagpur Municipal Corporation from passing orders in accordance with law.
