Issues / Allegations / Violations
On 18-07-2024, petitioner entered a sale agreement to sell his property for Rs 4.11 crore and received an advance of Rs 60 lakh.
The deal failed to materialise; petitioner did not return the advance, leading to FIR No. 816 of 2025 under Sections 318(4) & 61 of the Bharatiya Nyaya Sanhita, 2023.
Petitioner’s anticipatory bail was rejected by the High Court; interim bail was later granted on 29-01-2026.
A civil suit (No. 1832 of 2025) was filed by petitioner seeking decree for forfeiture of the Rs 60 lakh advance.
Findings & Observations
Parties negotiated and agreed that repayment of Rs 60 lakh to Ms. Manjeet Kaur would lead to withdrawal of the FIR.
Petitioner paid Rs 60 lakh from an account in the name of M/s Neha Enterprises; the wife expressed satisfaction with the repayment irrespective of the source.
The repayment rendered the civil suit for forfeiture infructuous.
Both the criminal FIR and the civil suit were therefore considered settled by mutual agreement.
Penalties / Settlements / Directions
The Supreme Court, invoking powers under Article 142 of the Constitution, quashed FIR No. 816 of 2025.
The Court also quashed civil suit No. 1832 of 2025 pending before the Civil Judge (Senior Division), Panipat.
The parties were directed to inform the concerned police station and the civil court of the quashment.
Corrective Actions & Future Obligations
The petitioner may approach Haryana Shehri Vikas Pradhikaran (HSVP) to rectify any mistake in the revenue records concerning the subject property.
Any application by the petitioner to HSVP will be decided on its own merits, without influence from observations in this order.
