Authority: High Court of Jharkhand at Ranchi, Hon'ble Mr. Justice Rajesh Shankar
Order Date: 12.10.2026
Case Overview
- Petitioner: Tata Hitachi Construction Machinery Co. Pvt. Ltd. (formerly Telco Construction Equipment Co. Ltd.), represented by Head Finance (Plants) Keshava Kumar Sinha.
- Respondents: 1) Employees' Provident Fund Organization (EPFO) – Regional Office, Purulia Highway, Jamshedpur; 2) Assistant Provident Fund Commissioner, Jamshedpur; 3) Assistant PF Commissioner (Compliance); 4) Recovery Officer, EPFO; 5) Earth Mover Consultancy Pvt. Ltd., represented by Managing Director Aziz Hussain.
- Nature of dispute: EPFO issued an order dated 31.07.2017 under Section 8F of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, directing the petitioner to pay Rs 28,03,041 by demand draft to the Regional Provident Fund Commissioner. The order was based on the premise that Tata Hitachi was the principal employer of Earth Mover Consultancy, which had failed to deposit PF contributions for its employees from Oct 2012 to Mar 2015.
- Petitioner’s contentions: (i) The relationship with Earth Mover Consultancy was a principal‑to‑principal dealership and work‑order arrangement; Tata Hitachi had no control over the contractor’s employees. (ii) Earth Mover Consultancy was a separate EPF establishment (code JH/JAM/14191) and solely liable for its own PF dues. (iii) The petitioner had raised these points in a reply dated 31.08.2017, but EPFO ignored them and proceeded to issue a recovery certificate (05.01.2018) and a demand notice (19.01.2018) under Section 8B.
- Respondent‑EPFO’s contentions: EPFO argued that Earth Mover Consultancy was an establishment under the Act from 22.03.2004, and after a complaint and enquiry (Section 7A) it assessed dues of Rs 19,98,087 (principal + admin charges) plus Rs 8,04,954 interest, totalling Rs 28,03,041. Under Section 8A, EPFO claimed the principal employer (the petitioner) must make good the contractor’s default and may recover the amount from the contractor.
- Procedural history: EPFO’s enquiry began after a complaint on 16.12.2015; a notice to Earth Mover was issued on 12.09.2016; an order on 09.06.2017 directed Earth Mover to deposit the assessed amount; the petitioner appeared before EPFO on 12.01.2017, 18.01.2017 and 16.05.2017. Despite the petitioner’s reply, EPFO issued the Section 8 certificate on 05.01.2018 and the demand notice on 19.01.2018.
Final Outcome
- The High Court held that the order dated 31.07.2017, issued under Section 8F, was based on an erroneous presumption that Tata Hitachi was the principal employer of Earth Mover Consultancy and that the petitioner was not afforded a proper hearing on the grounds raised in its 31.08.2017 reply.
- Consequently, the Court quashed and set aside the impugned order, the Section 8 certificate, and the demand notice.
- The Court directed that EPFO may pursue any other lawful action for recovery of the Rs 28,03,041 directly from Earth Mover Consultancy, the actual employer establishment, but not from Tata Hitachi.
- All pending interlocutory applications, if any, were disposed of.
