This interlocutory application (IA No.6719/2026) was filed by Uttar Pradesh Pashudan Udgyog Nigam Ltd. (Appellant) against Paramjeet Singh Bhatia, Resolution Professional of Hind Agro Industries Ltd. The Appellant explained that the delay occurred due to two primary reasons: (1) certain documents forming part of the record dated back to 1993 and 1996, and owing to their age and condition, considerable time was consumed in obtaining legible typed copies; (2) certain documents relied upon and annexed with the appeal were in vernacular language and required proper translation before being filed before the Tribunal. The Appellant contended that the delay was neither intentional nor deliberate, but occurred due to these bona fide and unavoidable circumstances.
Final Outcome
The Registrar, after hearing learned counsel for the Appellant and perusing the averments in the IA as well as office report, noted the 36-day delay in re-filing the Memorandum of Appeal. The case has been listed before the Hon'ble Bench under the heading 'for admission with defect (fresh case)' for appropriate orders regarding the condonation of delay and admission of the appeal.
