Viatris Inc., through its subsidiary Mylan Pharmaceuticals, filed a lawsuit in a Delaware federal court on Thursday seeking a declaratory judgment that its planned generic version of the weight‑loss injection Wegovy will not infringe Novo Nordisk A/S’s patent covering the method of administering single‑dose Wegovy pens. The complaint asks the court to determine that the generic product does not violate the Danish company’s intellectual‑property rights.
Novo Nordisk reported that its semaglutide‑based weight‑loss medicines Wegovy and Ozempic together generated nearly $31 billion in revenue during the most recent fiscal year. Under the current patent portfolio, generic versions of both Wegovy and Ozempic are prohibited from entering the United States market until the semaglutide patents expire in 2032.
The filing follows earlier patent disputes in which Novo Nordisk settled with Mylan and other manufacturers over proposed generic versions of Wegovy and Ozempic. The present action adds to the ongoing litigation landscape surrounding the high‑value semaglutide franchise.
