WBSTC Contract Workers' Regularization Review Ordered

Petitioners: Abhishek Mukherjee & Ors., contractual workers of West Bengal Surface Transport Corporation Limited (WBSTC), with service tenures ranging from over 10 to 17 years.
Respondents: The State of West Bengal & others, including Transport Corporation Limited (respondent No.3) and additional government entities.
The petition seeks regularisation of service and enhancement of pay pursuant to Government of West Bengal memorandums issued between 2010 and March 2024.
Petitioners have made representations to respondent No.3; the validity of the memorandums is presently under consideration before a Division Bench of this Court.
No stay has been ordered; affidavits of service have been kept on record and affidavits have been called for.
It was noted that several similarly situated contractual workers in other government establishments are already receiving benefits under the same notifications/memorandums.

The Court directs respondent No.3 to consider the petitioners' representations in light of the existing, prevalent, and applicable memorandums, subject to the petitioners fulfilling the eligibility criteria mentioned therein.
The decision on regularisation and pay enhancement must be finalized by 30 September 2026 and communicated to the petitioners and the relevant departments of the Government of West Bengal within one week thereafter.
If the petitioners are found eligible, enhancement of pay and regularisation, as may be decided by respondent No.3, will be extended to them.
No order as to costs.
An urgent photostat certified copy of the order may be obtained by the parties upon usual undertakings.
