WBTC Limited Ordered to Pay 6% Interest on Delayed PF Benefits

Background: The petitioner’s mother was an employee of West Bengal Transport Corporation. She retired on 31 October 2024 and passed away on 29 May 2026.
Dispute: Delay in releasing provident fund (PF) benefits to the mother. The PF amount was finally paid on 9 September 2025, but the petitioner alleges considerable delay.
Representations: A supplementary affidavit filed on 7 May 2026 asserted the right to interest on the delayed payment. A further representation was made on 15 July 2026 after the mother’s death.

The concerned authority of West Bengal Transport Corporation is directed to pay interest at 6% per annum on the PF amount from the date following the mother’s superannuation (post‑31 Oct 2024) until the date of release.
The interest must be paid within three months from the date of communication of this order.
In case of default in payment of the stipulated interest, the respondent authority shall pay interest at 8% per annum on the benefits.
If necessary, the State respondents shall provide funds to the corporation to enable compliance with the above direction.
The writ petition is disposed of; no order as to costs.
An urgent photostat certified copy of this order may be supplied to the parties upon compliance with all requisite formalities.
