The company holds an arbitration award in its favor amounting to ₹1.51 crore, with ₹72,00,000 and ₹1,17,17,260 already submitted via demand drafts to the Commercial Court, requiring an active company status to receive these funds.
Final Outcome
The NCLT allowed the appeal and ordered restoration of the company's name subject to the following conditions: (1) Payment of cost of ₹25,000 for each financial year of default (totaling ₹1,00,000) to the Registrar of Companies; (2) Filing all pending statutory documents including Financial Statements and Annual Returns along with prescribed fees within 45 days of restoration; (3) Submission of a certified copy of the order to the Registrar of Companies within 30 days. The Registrar of Companies was directed to restore the original status of the company as if the name had never been struck off, which would also result in the de-freezing of any bank accounts.
