NCLAT Upholds CCI Penalty on Hari Narayan Bihani Cartel

NCLAT dismissed appeals by Keshav Bihani and Hari Narayan Bihani against CCI orders penalizing them for bid-rigging cartel.
The tribunal found the firm and its partner violated Section 3 of Competition Act by participating in polyacetal tube cartel from 2019-2020.
CCI imposed penalties of ₹11.5 lakh on the firm and ₹8.1 lakh on Keshav Bihani based on 5% of average income/turnover.
The ruling affirmed CCI's use of email evidence and Section 48 liability for individuals in pre-amendment Competition Act cases.
