Petitioners Dhaniram Pokhriyal and others initially filed Writ Petition Service Single No. 1568 of 2026; they later sought to withdraw their petitions (Petitioner No.1 and No.2) and were granted liberty to file fresh petitions with better particulars.
Mahendra Singh Rawat continued the writ petition, seeking a direction that the respondents (State of Uttarakhand and others) grant him the benefit of the selection/promotional pay scale by counting the services rendered before the grant in aid.
Counsel for the petitioner argued that the matter is covered by a prior judgment of a Coordinated Bench in WPSS No.1955 of 2015 (Munendra Singh Rana & others vs. State of Uttarakhand) and related petitions decided on 27.03.2017, which were subsequently upheld by the Division Bench in SPA No.279 of 2018 (State vs. Harish Singh Bora & others). The State’s standing counsel admitted this point.
The Court accepted the reliance on the earlier judgments and found that the petitioner’s claim aligns with the legal principles established therein.

The Court allowed the writ petition in favor of Mahendra Singh Rawat, directing the respondents to release the Selection Grade/Promotional Pay Scale to him, counting his service from the date of his initial appointment.
The respondents must implement this direction within eight weeks from the date of the order and pay any arrears due.
Interest on the arrears is to be paid at 9% per annum. If the arrears are not released within the stipulated eight‑week period, the petitioner is entitled to interest at 18% per annum.
