CCPA Imposes ₹10 Lakh Penalty on Dial4Trade for Unregulated Ammonium Nitrade Sales

The Central Consumer Protection Authority (CCPA) has imposed a financial penalty of ₹10 lakh on Dial4Trade Technologies Private Limited for facilitating the online listing, hosting, advertising, and sale of Ammonium Nitrate on its e-commerce platform without mandatory regulatory safeguards required under law. The final order was passed by CCPA, headed by Chief Commissioner Smt. Nidhi Khare and Commissioner Shri Anupam Mishra, under Sections 10, 20 and 21 of the Consumer Protection Act, 2019.

Specific Violations and Regulatory Failures

During examination, CCPA found that Dial4Trade allowed Ammonium Nitrate to be listed and made available for purchase without adequate safeguards, including disclosure of valid PESO (Petroleum and Explosives Safety Organisation) licence details of sellers, verification of identity and licensed status of buyers before purchase, mechanisms to ensure traceability of transactions as required under the Ammonium Nitrate Rules, 2012, and cautions regarding legal restrictions on possession and use of the substance. The listing was accompanied by imagery depicting explosions and blast effects, which the CCPA observed was likely to attract attention to the product rather than communicate its hazardous and regulated nature.

Legal Interpretation and Platform Defenses Rejected

The CCPA held that product listings on digital marketplaces constitute "advertisements" under Section 2(1) of the Consumer Protection Act, 2019, and presenting regulated explosive substances for sale without informing users about licence requirements constitutes misleading advertisement and unfair trade practice under Sections 2(28) and 2(47) of the Act. Dial4Trade's contention that it operates as a Business-to-Business (B2B) marketplace intermediary was rejected because the platform permitted purchase in quantities as low as a single unit without minimum order quantity or institutional-buyer verification mechanisms. The CCPA also rejected the platform's reliance on intermediary safe-harbour protection under Section 79 of the Information Technology Act, 2000, noting that such protection requires compliance with due-diligence requirements and that a reactive removal mechanism was insufficient for regulated hazardous substances.

Sector-Wide Examination and Ongoing Actions

This action forms part of CCPA's ongoing examination of e-commerce platforms concerning unauthorized online sale of hazardous chemicals, explosive substances and related precursors. The substances under examination include Ammonium Nitrate, Gun Powder, Picric Acid and Pentaerythritol Tetranitrate (PETN). The matter is currently under examination for seven additional platforms: India MART, Justdial, Sigma-Aldrich India, Exporters India, Ibuychemikals, Alpha Chemika, and TradeIndia.

Compliance Directives and Consumer Protection Emphasis

The CCPA directed Dial4Trade to immediately discontinue the listing, hosting, advertising or facilitation of sale of Ammonium Nitrate or any other substance classified as an explosive under the Explosives Act, 1884. The Authority reiterated that consumers rely on product listings for online purchases and that e-commerce platforms must undertake appropriate due diligence for regulated products, particularly those posing public safety risks.
